Terms and Conditions for Outbound Tour

The conformation of your booking binds you into a contract with M/s. Holiday Mirchi. The confirmation of your tour/travel services when we receive the deposit sum from your end, brings into existence a legally binding contract between us.


A minimum deposit of 25% of the total cost is to be paid by you to M/s. Holiday Mirchi, for the services rendered by us. This deposit is required to hold the booking on a confirmed basis.

Balance Payment

You are required to complete the payment balance 15 days prior to the start of services. Any booking which is made within 15 days of the date of services will be treated as a late booking. In such cases, the person concerned will be required to make full payment at the time of booking itself.

Note: Apart from the above mentioned cases, in case of booking for hotels, resorts or special train journeys during the peak season (which include any festivals or national holidays), the person concerned shall be required to make the full payment at the time of booking itself.

Payment Process:

For domestic and international clients

Domestic clients can complete the payment process by following any of the methods mentioned below:-

  • By Online Payment Gateway system through (American Express / Visa / Master Card / Discover / Diners Club).
  • By Debit Card verified by Master/ Visa / Maestro.
  • By Offline Credit Card Payment (American Express / Visa / Master Card / Discover / Diners Club).
  • By Cash / Check / Demand Draft.
  • By Bank Transfer (RTGS & NEFT).

International clients can complete the payment process by following any of the methods mentioned below:-

  • By Online Payment Gateway system through (American Express / Visa / Master Card / Discover / Diners Club).
  • By Debit Card verified by Master / Visa / Maestro.
  • By Offline Credit Card Payment (American Express / Visa / Master Card / Discover / Diners Club).
  • By Bank / Telex Transfer to our Bank A/c.

In those cases where the payment process is transacted through credit/debit card, the bank charges (3% extra) would be levied over and the above the total amount.


All payments made should be free and clear of, and without deduction and withholding for, any kind of taxes, either for the present or for the future.

The onus of paying bank charges, if any, for remittance (by remitting bank or by intermediary bank), will fall solely on the payer.

Payment Method

Any and all payments are to be made in favor of M/s Holiday Mirchi.

Policies related to Early Departure/No-show/Cancellation

Any cancellation of tour/travel services due to the existence of any reasons, avoidable or unavoidable in nature, should be conveyed to us in writing. The cancellation charges will become effective from the moment we receive the cancellation letter, following which, the cancellation charges would come into existence. The cancellation charges are mentioned below:

  • 60 days & prior to arrival - 10% of the tour/service cost.
  • 59 days to 30 days prior to arrival - 20% of the tour/service cost.
  • 29 days to 15 days prior to arrival - 25% of the tour/service cost.
  • 14 days to 08 days prior to arrival - 50% of the tour/service cost.
  • 07 days & less, prior to arrival or no show – No Refund.

N.B. - In case of cancellation of any tour/travel services after the confirmation of booking, a minimum of 10% service charges would be applicable, irrespective of the above mentioned cancellation slabs.

In those cases where cancellation has occurred after the commencement of the journey, the refund which is due to the payer would be restricted to a limited amount. The particular sum of the refund would depend on the amount that we are able to recover from the hoteliers patronized by us. Our responsibility to refund would not come into effect in cases of unused hotel accommodation, missed meals, chartered transportation etc.

A cancellation policy (which would be advised as and when required), shall come into effect in case of special train journeys like Royal Rajasthan on Wheels, Golden Chariot, Palace on Wheels, Deccan Odyssey, Indian Maharaja & Maharajas Express.

In case booking cancellations are made during high peak season bookings (from 20th Dec to 15th Jan), for any reason whatsoever, no refund would be applicable for the respective cancellation.


As regards the refund of unused/unutilized services, the particular refund amount would be arrived at on the basis of the cancellation policy mentioned above, following which, the amount would be refunded to the person who has made the initial payment. The entire process related to the refund amount would take about 2-4 weeks, due to the complexities of banking procedures involved. Bank charges would be debited from the refund amount in cases where refund is made to the credit card account or to the bank account.

Arrival and Departure Policy:

Check-In Timings: 1200 - 1500 Hours

Availability is dependent on early arrival. The guarantee of an early check-in is subject to reservation made on the previous night.

Check-Out Timings: 1000 - 1200 Hours

Requests related to late check-outs will be entertained, subject to the availability and payment procedures involved.

Added Usage of Vehicle

Any added usage of vehicle (cars/coaches with the driver), is not included in the service, and thereby, any added usage of vehicle after sightseeing or transfer is prohibited, unless such usage is mentioned in the detailed itinerary/services.

Our limitations and liabilities:

Any subsequent hikes in the entrance fees of museums/monuments, fuel cost, taxes or guide charges by the Govt. of India, shall be deemed as extra costs even after the finalization of the tour/services costs.

Holiday Mirchi rates are arrived at after negotiations on the prevailing rates with the airlines, hotels etc. The rights to modify and alter the rates without prior notice rests with the hotels and airlines. In such cases, we reserve the right to modify and alter the rates in keeping with the modifications and alterations undertaken by the hotels and airlines.

Holiday Mirchi and its associates act exclusively in the capacity of an agent for the airlines, hotels, transporters, contractors and railways, who provide other services, and consequently, the issuance of all contracts, tickets, receipts and exchange orders undertaken by us are subject to the terms and conditions under which the aforementioned services are rendered by them.

Holiday Mirchi itineraries are of a sample nature only, their purpose being to give you a general idea of the likely trip schedule. Itinerary changes before the tour or during the trail shall be determined and dictated by the presence of several factors, including road conditions, weather, the physical ability of the participants etc. The right to amend any aspects of the itinerary without any prior notice, such as accommodation and transportation, in the interest of the trip, participants' safety, well-being and comfort, and without any provisions for rebate, allowance and refund and extra cost, rests solely with Holiday Mirchi.

Holiday Mirchi shall not be held liable in any way for any alterations or delay in program or any expenses incurred due to injury and damage, or special and consequential loss, either directly or indirectly, due to natural hazards, cancellation of flights, accident or mishap, breakdown of equipment and machinery, transportation failure, ill-health, unfavorable weather conditions, landslides, strikes or shutdowns of a political nature, untoward incidents at sea, fire, floods, unexpected declarations by governments and authorities, riots, wars, civil disturbances, epidemics, larceny, theft, custom or medical department regulations, quarantines, defaults, or any cases beyond our control or any unpredicted and unforeseeable incidents or such cases related to the above mentioned nature, including any extra expenses and liability which shall be borne by the clients. The client shall be solely responsible for any extra expenses or liability borne by him due to the abovementioned causes.

Holiday Mirchi shall accept no liability towards the clients, or bear any responsibility towards them in any manner whatsoever, or towards their legal representative, for any kind of damages or loss or property incurred due to death or injuries, including the loss of services which the clients may face on account of any negligence or default by any transportation company, hotel agents or any other body of persons. This provision shall extend to any kind of damages incurred on the various means of transportation, such as any automobile, bicycle, motorboat or any common carriers, due to any kind of negligence or otherwise, during the time of their being engaged during the tour. Further, clients availing various services supplied by hotels such as sailing boats, bicycles, sporting equipment, scuba diving gear, shall do so at their own risk.

Holiday Mirchi holds the right to cancel any service, if the impracticability of any trip, tour or passage seems pretty evident, for any reason, or reasons whatsoever, following which, the client shall be refunded and consequently, and shall not have any further claim against the company in any manner.

Holiday Mirchi may, at its discretion, refuse to carry out the contract with any person, or persons, it deems undesirable, and shall not be required to offer any kind of explanation for doing so.

Any and all disputes arising in connection with this agreement shall be referred to an Arbitrator appointed by Holiday Mirchi, subject to the jurisdiction of Delhi (India) Courts only. The validity, interpretation, construction, enforcement and performance of these terms and conditions shall be governed by the laws of India.

Payments & Bookings
  1. All bookings related to reservation will be accepted at least 7 days prior to the first check-in date. A deposit for one night stay, or Rs 10,000, shall be required, if the booking for the check-in is required within five working days (during the peak season, secured reservation is subject to full payment). In some cases, a 100% advance payment may be required.
  2. The client shall provide accurate details during the booking process.
  3. No amendments will be entertained after the commencement of travel.
  4. All bookings shall be made on pre-payment basis (i.e. the payment shall be paid in full prior to the passengers' departure and in foreign currency as indicated in the manual while adhering to the RBI guidelines/rules/circulars issued by the concerned authorities, which also include the provisions of FEMA 1999.
  5. All the passengers travelling shall carry with them their original passport and tickets, besides conducting all payments in INR/Foreign Currency.
  6. In the event of there being a fluctuation in the currency rates, all rates shall be subject to a revision.
  7. All rates, terms & conditions are subject to change without notice.
  8. During the peak season/trade fair/New Year/Christmas Eve, Public holidays etc., there could be variation of policies for bookings/reservations made by the hotel management.
  9. The confirmation of the reservation shall depend on the passenger returning his duly completed booking form along with an initial deposit of Rs 10,000.
Policy related to Cancellation

The cancellation/amendment of the confirmed booking shall be treated as confirmed only when you fill and sign the cancellation advice, doing which will amount to the cancellation of your particular reservation; consequently, the cancellation charges will apply. The cancellation of any part of a confirmed booking/reservation, will require a cancellation advice in writing. The cancellation policy has been mentioned below.

Cancellation charges per person
  • 21 days prior to the departure of the tour - 10 % of the total tour cost.
  • 20 - 15 days prior to the departure of the tour - 50 % of the total tour cost.
  • 14 - 8 days prior to the departure of the tour - 70 % of the total tour cost.
  • 7 days or less prior to the departure for the tour or a "No Show" - 100 % of the total tour cost.
  • For Cancellations/Amendments made whilst on tour - 100 % of the total tour cost.
  • The client would be intimated separately on case to case basis in the event of there being any variation or change of the cancellation charges.
  • All refunds will be issued in INR in India only, as per the RBI regulations.
  • Refunds related to amendment and cancellation will either be paid directly or by the preferred sales agent through whom you have forwarded the booking through us.
  • The entire process of refunds would take a minimum of 30 days, and any unutilized services (e.g. entrance fees, sightseeing, meals etc.), shall not be refunded.
  • Cancellation of reservation after commencement of travel shall be refunded.
Excluded from the Tour Cost

The tour cost shall not include insurance sightseeing, cost of gratuities, excess baggage charges, drinks, tips, laundry, airport taxes, meals except where indicated and items of personal nature.

Peak Season/Festivals/Trade Fairs

Booking during peak season/festivals/trade fairs shall be subject to certain special conditions, which will be advised at the time of booking.

Extent of Activity

Being travel and holiday organizers only, we do not operate any airline, neither do we control or own any shipping company, coach or coach company, or any other facility as mentioned in the manual. Our scope of activity begins and ends with the selection of all ingredients in a clients' holiday, and because our scope of activity is limited to selecting and inspecting them, rather than running them, we cannot be held responsible for any injury, death, loss or damage, arising from the act or default of the management or employees of any hoteliers, shipping companies, airlines, coach owners/coach operators who happen to be the company's independent contractors emerging from our normal selection.

Hotel Check In and Check Out Timings

The check-in timings at all hotels worldwide is 1400 hrs., while the check-out time is 1200 hrs. Under no circumstances can early check-in and late check-out be guaranteed, as these factors are subject to availability at the hotel. Clients arriving early in the morning and requiring the room on his/her arrival should place a request for room confirmation the previous night.

Other Terms
  1. The term "client" refers to the personnel/persons in whose name, or on whose behalf, the booking is made.
  2. The term "company" refers to Holiday Mirchi.
  3. The term independent contractors shall mean "hotelier/hotel owners," owner of any shipping company or airline or railway, coach owner/ferry boat owner/boat owner/operator, or any other person who, after his selection by the company, renders service to the client. No person other than the company in writing, is authorized to add, vary, amplify or waive any stipulation, representation or terms and conditions.
  4. Under no circumstances whatsoever shall the company be liable to its clients for: -
    • Personal injury, sickness, accident, death, loss, discomfort, delay, increased expenses, consequential loss and/or damage or any misadventure, however caused.
    • Any omission, act, default or other person or independent contractor or agent or servant employed by them who maybe either engaged or concerned in the provision of accommodation, carriage facilities, refreshment or services for the client or for any other person travelling with him howsoever caused.
    • Any damage to baggage or personal effects, whether temporary or permanent, howsoever caused in this condition; here, the term howsoever caused includes negligence on the part of any person.
  5. On part of the company, no liability arising in any way out of this contract in respect of any holiday, tour, and excursion facility, shall harbor expectations of the total amount being paid or agree to be paid for the holiday and shall under no case include any consequential loss or additional expense whatsoever.
  6. Any complaints that the client may have in respect of the service provided by any of the independent contractors, shall be notified in writing to the independent contractor along with a copy to the Holiday Mirchi Office where the booking has been made, upon his return. Doing so will enable our company to take up the matter with the independent contractor so that in the future, other clients are spared similar difficulties and shortcomings.
  7. Each of these provisions are severable from the other, consequently, in case of one provision being illegal, invalid or unenforceable, the remaining provisions shall nevertheless have full force and effect.
  8. All foreign exchange payments are governed by RBI/GOI rules & regulations.
  9. While in Europe, tips are mandatory.
